Descriptions of changes to the operator's documents
In connection with the amendment to the Act of July 16, 2004 – Telecommunications Law (i.e. Polish Journal of Laws of 2019, item 2460 as amended) and the need to adapt the contractual provisions to the content of the amended regulations, we inform as follows:
- If the Communications Service Delivery Agreement running between you and ATM S.A. contains provisions stating that: “The agreement for a definite period of time shall be automatically extended for an indefinite period of time after its validity,” you have the right to terminate it at any time with one month’s notice. During the notice period, you will only bear the costs of providing the telecommunications services covered by the contract.
- If the Communications Service Delivery Agreement running between you and ATM S.A. contains provisions stating that: “The agreement is concluded in the document form, and its termination must be made in writing under pain of nullity,” you have the right to terminate it, as well as to withdraw from it or terminate it in the document form.
The above changes result from the changes in legal regulations. If the changes concern the provisions resulting from the communications service delivery agreements concluded between you and ATM S.A., and do not meet with your acceptance, you have the right to submit a statement of termination of the Communications Service Delivery Agreement by December 21, 2020 at the latest.
Due to the fact that the above change results from the amendment of the law, the use of the possibility to terminate the agreement in accordance with the above may involve the need to incur claims for damages in the amount and under the conditions specified in the Agreement and/or the Communications Service Delivery Regulations.
We would like to inform you that on January 1, 2017 in the territory of the Republic of Poland comes into force the Regulation (EU) 2015/2120 of the European Parliament and of the Council of November 25, 2015 laying down measures concerning open Internet access and amending Directive 2002/22/EC on universal service and users’ rights relating to electronic communication networks and services and Regulation (EU) no. 531/2012 on roaming on public mobile communication networks within the Union.
Due to the need to modify the Communications Service Delivery Regulations and the specimen of agreement, as well as the obligation, stemming from Article 60a (3a) of the Act of July 16, 2004 – the Telecommunication Law (Journal of Laws of 2016, item 1489, as amended) to inform our Customers of the changes being introduced, we inform you of the modifications in the letter attached below. The amendments shall enter into force from January 21, 2017.
